This Privacy Policy describes how Pinewood Capital LLC(“Pinewood Capital,” “we,” “us,” or “our”) collects, uses, shares, and protects information about you when you use our website, apply for funding, or communicate with us — including via SMS text message. By using our services or submitting your information, you agree to the practices described in this policy.
1. Information We Collect
We collect the following categories of personal information:
- Identity Information: Full name, date of birth, government-issued ID details, Social Security Number (for credit and underwriting purposes).
- Contact Information: Phone number (including mobile), email address, mailing address.
- Business Information: Business name, EIN, industry, monthly revenue, time in business, bank statements, and other financial documents you provide.
- Communications: Records of your inquiries, application notes, and correspondence.
- Technical Data: IP address, browser type, device identifiers, and pages visited on our website (collected via cookies and similar technologies).
2. How We Use Your Information
We use the information we collect to:
- Evaluate and process your application for business funding;
- Communicate with you about your application and account status;
- Send transactional SMS messages (e.g., application updates, document requests, funding confirmations);
- Send marketing SMS messages about Pinewood Capital products and offers — only with your express written consent;
- Comply with applicable laws, regulations, and underwriting requirements;
- Detect and prevent fraud;
- Improve our website and services.
3. SMS Communications — 10DLC Disclosure
Important SMS Terms
- Message Types: Pinewood Capital sends two categories of text messages: (1) Transactional / Customer Notification messages — such as application status updates, funding confirmations, document requests, and account alerts; and (2) Marketing messages — such as product announcements, promotional offers, and re-engagement campaigns.
- Opt-In: By providing your mobile phone number and submitting our application form (or otherwise expressly consenting), you agree to receive SMS messages from Pinewood Capital. Marketing messages require separate, express written consent. Consent is not a condition of purchase or receiving funding.
- Message Frequency: Message frequency varies. You may receive up to 4 marketing messages per month and transactional messages as needed based on your application or account activity.
- Carriers: Message and data rates may apply. Supported carriers include AT&T, T-Mobile, Verizon, and other major U.S. carriers. Carrier is not liable for delayed or undelivered messages.
- Opt-Out: You may opt out of marketing SMS messages at any time by replying STOP to any message. You will receive a one-time confirmation that your number has been removed. You may not be able to opt out of critical transactional messages related to an active funding agreement.

- Privacy: No mobile opt-in data or consent information will be shared with third parties for marketing purposes.
Our SMS program is registered with The Campaign Registry (TCR) under a 10-digit long code (10DLC) campaign in compliance with CTIA guidelines and applicable carrier requirements.
4. How We Share Your Information
We do not sell your personal information. We may share your information with:
- Funding Partners and Lenders: For underwriting, syndication, or referral purposes relevant to your application;
- Service Providers: Third-party vendors who assist with CRM, SMS delivery, identity verification, credit reporting, and document processing, bound by confidentiality agreements;
- Credit Reporting Agencies: As part of underwriting review;
- Legal and Regulatory Authorities: When required by law, subpoena, court order, or to protect our legal rights;
- Business Transfers: In connection with a merger, acquisition, or sale of assets, with notice to you.
SMS Opt-In Data: We will not share your mobile number or SMS opt-in data with any third party for their own marketing purposes.
5. Cookies and Tracking Technologies
Our website uses cookies, pixel tags, and similar technologies to recognize your browser, analyze site traffic, and support marketing attribution. You may disable cookies through your browser settings; however, certain site features may not function properly. We do not respond to Do Not Track signals at this time.
6. Data Retention
We retain personal information for as long as necessary to fulfill the purposes described in this policy, comply with legal and regulatory obligations (including record-keeping requirements for commercial lending), and resolve disputes. Application data for declined or withdrawn applications is typically retained for 7 years.

We implement industry-standard technical and organizational safeguards — including encryption, access controls, and secure transmission protocols — to protect your personal information. No method of electronic transmission or storage is 100% secure; we cannot guarantee absolute security.
8. Your Rights and Choices
Depending on your state of residence, you may have rights to:
- Access the personal information we hold about you;
- Request correction of inaccurate information;
- Request deletion of your personal information (subject to legal retention requirements);
- Opt out of marketing communications (including SMS and email);
- Non-discrimination for exercising these rights.

9. California Privacy Rights (CCPA / CPRA)
California residents have additional rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), including the right to know, delete, correct, and opt out of the sale or sharing of personal information. Pinewood Capital does not sell personal information. To submit a verifiable consumer request, contact us using the information in Section 8.
10. Children's Privacy
Our services are not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If you believe we have inadvertently collected such information, please contact us immediately.
